What is Academic Misconduct?
Academic misconduct is a violation of Swarthmore College’s standards of academic integrity. It can take many forms, including plagiarism, cheating, falsification of data, and unauthorized collaboration. Unfortunately, misinformation and a lack of knowledge about what constitutes academic misconduct are common among students, leading to unintended violations.
Examples of Academic Misconduct
The student handbook provides examples of several forms of academic misconduct, including but not limited to:
- Copying from another student’s paper, exam, or problem set where collaboration is not allowed.
- Submitting work that closely paraphrases a source without proper attribution.
- Submitting the same assignment in more than one course without prior approval from each instructor.
It’s essential to note that the above examples are not an exhaustive list of all forms of academic misconduct. Therefore, we recommend that you familiarize yourself with Swarthmore College’s academic misconduct policy.
The Consequences of Academic Misconduct
If you are found guilty of academic misconduct, you may face serious consequences, such as probation, suspension, or expulsion. These penalties can have long-term effects on your academic and professional career. That’s why it’s crucial to seek legal representation from a knowledgeable and experienced student defense attorney.
The Procedures for Handling Academic Misconduct
Swarthmore College employs two methods for handling academic misconduct, including:
Course-level Adjudication
If an instructor has evidence that supports their suspicions of academic misconduct, they will consult with the department chair about the case. Afterward, the instructor will notify the student in question about the allegations and request an explanation. If the instructor’s suspicions persist, they will submit a report to the director of student conduct, who will then bring the case to the Judiciary Committee for resolution.
Administrative Adjudication
During the course of the process, a student may request an alternative method of resolution known as administrative adjudication. This process involves a student conduct administrator, an objective party, meeting with the instructor and the accused student to determine responsibility and render a decision on any applicable sanctions. The decision will be based on the “preponderance of evidence standard.”
The Sanctions for Academic Misconduct
The Committee on Academic Requirements (CAR) determines the sanctions to be imposed for academic misconduct cases. These sanctions consider the severity of the charge and the student’s prior violations. The corrective actions include, but are not limited to:
- A warning that requires periodic check-ups with the dean
- Probation, which may include removal from probation
- Required withdrawal for at least one semester to engage in meaningful activities before returning
The Appeals Process
If a student is dissatisfied with the determination of responsibility or sanctions, they may appeal in writing to the dean of students or designee within three business days. The limited grounds for an appeal include new evidence that was unavailable at the time of the decision, procedural errors that significantly impacted the fairness of the decision, or sanctions that are grossly disproportionate to the violation committed.
