Unlike other hearings proceeding in set agendas, sexual misconduct hearings’ structure rests on Hearing authority’s discretion. However, both parties are guaranteed certain rights during formal resolution proceedings:
– Both complainant(s) and respondent(s) can respond to evidence presented against them.
– Each party could bring supporting witnesses at their own discretion.
– Final decisions shall apply standards based on “the preponderance of evidence.”
Presence of Adviser
Having an adviser is critical throughout proceedings. While students are entitled to having someone present during presentations and seeking assistance throughout hearings – tailored expertise plays a significant role in the outcome.
