If a party does not have an advisor present, the school must provide one without charge.
The Decision-Maker(s) ultimately bases their decision on the “preponderance of evidence” or “clear and convincing evidence” standard, and each school will decide which standard they will use. If found responsible for the charges, punishments levied under Title IX can be severe, including suspension or expulsion from school.
